Terms and Conditions – Vuelta Ibiza Kayak®

These Terms and Conditions govern the booking and participation in the active tourism activity organised by Vuelta Ibiza Kayak®.

By making any payment associated with a booking, the participant declares that they have read, understood and fully accepted these Terms and Conditions (including the cancellation policy).

2. Activity Description

Vuelta Ibiza Kayak® organises a guided, multi-stage sea kayaking expedition around Ibiza, with daily stages, in a group, on the dates advertised on the website or confirmed by email.

The route, schedule and direction of travel may be adjusted depending on weather conditions, sea conditions, group safety and/or justified organisational reasons.

3. What Is Included in the Price

The price includes, at a minimum, the services specified in the Active Tourism Contract provided to the participant.

In general, the price includes:

• Main equipment (kayak, paddle, life jacket and associated equipment).
• Qualified guides and logistical support.
• Mandatory insurance (accident and public liability insurance).
• Safety equipment (first-aid kit, radio and support boat during the stages).
• Internal transfers required for the activity (meeting point → starting point / finishing point → meeting point).
• Food and hydration as specified in the information provided for each edition (for example, breakfasts and some dinners).

Not included (unless expressly stated otherwise):

• Transport to and from Ibiza (flights/ferry) and external transfers.
• Lunches.
• Personal expenses.
• Any service not expressly listed as included.

4. Participation Requirements

To participate in the activity, participants must:

• Be able to swim.
• Be in suitable health and physical condition for a sporting activity at sea and an outdoor adventure.
• Not be under the influence of alcohol, drugs or medication that could compromise safety.
• Inform the guides in advance of any relevant medical condition, injury, functional limitation, allergy or intolerance they need to be aware of.

The organiser may request additional information where necessary for safety reasons.

5. Safety and Conduct Rules

Participants agree to:

• Follow the guides’ instructions at all times.
• Use the equipment correctly and take care of all gear provided.
• Behave respectfully towards the group, the environment and the staff.
• Respect the natural environment and leave all areas visited clean.

Vuelta Ibiza Kayak® reserves the right to prevent anyone from participating in, or to remove anyone from, the activity if their behaviour or condition poses a risk to their own safety or that of the group.

6. Reservations and Booking Procedure

Bookings are normally managed by email (and/or following prior contact via WhatsApp).

A place is considered confirmed once:

1. The participant has provided the information required for registration; and
2. The booking deposit has been received and proof of payment has been provided.

Until both steps have been completed, the place may be made available to other participants.

7. Prices and Payments

Prices published on the website may vary depending on availability, promotions or the specific conditions applicable to each week.

A booking is secured by an initial payment (the amount will be specified in the booking confirmation).

The remaining balance must be paid within the deadline specified by the organiser (usually 30 calendar days before the activity starts).

Payments must be made by bank transfer or Bizum, as specified in the booking confirmation email.

8. Cancellation Policy for Participants

Cancellations must be submitted in writing to: info@vueltaibizakayak.com.

Unless otherwise stated in the booking confirmation, the following conditions apply:

• More than 60 days before the activity starts: a full refund of the total amount paid.
• Between 60 and 30 calendar days before the activity starts: the full booking deposit (€200) is forfeited. However, if the participant takes part in the activity during the following season, the original deposit may be carried forward without having to pay it again.
• Within 30 calendar days before the activity starts: a refund of 50% of the total amount paid. However, if the participant takes part in the activity during the following season, the original deposit (€200) may be carried forward without having to pay it again.
• Within 15 calendar days before the activity starts: the total amount paid is forfeited. However, if the participant takes part in the activity during the following season, the original deposit (€200) may be carried forward without having to pay it again.
• Failure to attend: if the participant fails to appear at the date and time specified by Vuelta Ibiza Kayak® on the first day of the activity, the total amount paid will be forfeited.

8.1. Change of Participant (Recommended)

If a participant is unable to attend, they may transfer their place to another person (change of name), provided that:

• The organiser is notified in writing sufficiently in advance; and
• The replacement participant meets the participation requirements and signs the relevant documentation.

8.2. Change of Date (Subject to Availability)

Participants may request a change of week within the same season, subject to availability.

If there is a difference in price, the corresponding amount must be paid.

9. Cancellation or Modification by the Organiser

Due to weather conditions, safety concerns, justified organisational reasons or force majeure, Vuelta Ibiza Kayak® may:

• Modify the itinerary, schedule or stages; or
• Adapt the activity to ensure safety; or
• Suspend the activity in whole or in part.

If the activity is definitively cancelled before it begins, Vuelta Ibiza Kayak® will offer, as appropriate:

• A change of date; or
• A voucher for another edition; or
• A full or partial refund, as applicable.

10. Leaving the Activity After It Has Started

Once the activity has started, participants may withdraw for personal or health reasons.

From the moment they leave the activity, participants will no longer be under the direction or responsibility of Vuelta Ibiza Kayak® and will be responsible for their own circumstances and onward travel arrangements.

No refund will be issued if a participant leaves the activity after it has started.

11. Insurance

The activity includes the mandatory insurance policies for:

• Public liability; and
• Personal accident,

in accordance with applicable regulations and the insurance policies in force.

Participants are advised to consider taking out additional personal insurance (for example, travel insurance with assistance cover) if they deem it appropriate.

12. Equipment and Liability for Damage

Participants agree to take proper care of the equipment provided.

In the event of loss, breakage or damage caused by negligent or improper use, participants may be required to cover the cost of repair or replacement.

13. Photographs and Videos During the Activity

Photographs and videos may be taken during the activity for organisational, documentary and promotional purposes (for example, social media, the website and communications issued by Vuelta Ibiza Kayak®).

Participation in the activity implies acceptance that participants may appear in general, group or ambient images as part of the normal course of a group activity.

If a participant does not wish identifiable close-up images to be used or their name to be published in association with images, they may submit a written request to info@vueltaibizakayak.com, provided that compliance is reasonably possible.

14. Data Protection

In accordance with Regulation (EU) 2016/679 (General Data Protection Regulation, GDPR) and Spanish Organic Law 3/2018, participants are informed that their personal data will be processed by Vuelta Ibiza Kayak® for the following purposes:

• Managing bookings, registration and participation in the activity.
• Sending operational communications relating to the service.

Data will be retained for as long as necessary to fulfil legal and contractual obligations.

Participants may exercise their rights of access, rectification, erasure, objection, restriction of processing and data portability by submitting a request, together with a copy of an identity document, to info@vueltaibizakayak.com.

15. Complaints and Official Complaint Forms

Vuelta Ibiza Kayak® makes official complaint forms available to customers, in accordance with applicable regulations.

16. Applicable Law and Jurisdiction

These Terms and Conditions are governed by Spanish law.

Any disputes shall be submitted to the courts and tribunals with jurisdiction in accordance with applicable law.
